600mm Terms of Service

In these Terms, "600mm", "we", "us", and "our" refer to the provider of the Service.

1. These Terms

These Terms govern access to and use of 600mm.surf, including its websites, photographer studio, media previews, order-request tools, and technical delivery features (the "Service"). By creating an account, submitting an order request, or otherwise using the Service, you agree to these Terms.

If you use the Service on behalf of a business, you confirm that you have authority to bind that business. If you do not agree to these Terms, do not use the Service.

Local mandatory laws may give you rights that cannot be waived by contract. These Terms do not limit those rights.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to create a photographer account or submit an order request. A parent or legal guardian must act for a minor where required by applicable law.

The Service is not directed to children. Photographers must not knowingly upload or offer content in breach of laws protecting children or without any consent required from a parent or legal guardian.

3. What 600mm Does

600mm provides technical tools that allow photographers to:

  • upload and organise surf photos and short videos;
  • publish protected previews;
  • receive order requests and continue a conversation with a buyer through WhatsApp; and
  • make original files available through temporary download links after the photographer confirms release.

600mm is not the seller of a photographer's content. Unless a specific checkout page expressly says otherwise, 600mm does not set the sale price, collect or hold payment, act as an escrow provider, or act as agent for either party.

The photographer and buyer contract directly with each other. Their agreement covers the selected files, final price, payment method, licence, delivery, cancellations, refunds, taxes, and any other sale terms. The parties should confirm these terms in writing before payment.

600mm remains responsible for its own operation of the Service to the extent required by applicable law. Nothing in these Terms changes the legal role that follows from how the Service actually operates.

4. Photographer Accounts

Photographers must provide accurate account information, keep it current, protect their password and access links, and promptly notify us of suspected unauthorised access. Accounts may not be sold, shared with unauthorised persons, or used to impersonate another person or business.

We may require reasonable information to verify an account, investigate a complaint, comply with law, or protect users and the Service.

5. Photographer Responsibilities

A photographer who uploads or offers content through the Service is an independent seller and is responsible for:

  • the accuracy of session, content, pricing, licence, payment, and delivery information;
  • having all copyrights, permissions, releases, permits, and other rights needed to capture, upload, display, license, sell, and deliver the content;
  • respecting privacy, image, publicity, child-protection, property, location, drone, and other applicable rules;
  • clearly telling the buyer the price, currency, payment method, licence scope, delivery conditions, cancellation and refund terms before accepting payment;
  • issuing the purchased files after valid payment and providing reasonable buyer support;
  • taxes, records, licences, registrations, and consumer obligations applying to the photographer's activity; and
  • responding promptly to rights, removal, refund, and other legitimate complaints.

A photographer must not upload content that is unlawful, misleading, infringing, exploitative, defamatory, intimate without consent, dangerous, malicious, or otherwise prohibited by these Terms or applicable law.

6. Orders, Direct Payment, Delivery, and Refunds

An order submitted through 600mm is a request to contact the photographer about selected content. It is not confirmation that a sale has been completed or that payment has been accepted.

Payment is made directly between the buyer and photographer using a method they agree. Buyers should verify the photographer, the amount, currency, licence, delivery time, and refund terms before paying. 600mm does not receive payment information or control a third-party payment transfer in the current Service.

The photographer decides whether payment has been received and activates delivery. Temporary links may expire, and media may be removed under the retention periods displayed in the Service or communicated for the order. Buyers should download purchased files promptly and keep a lawful backup.

The photographer is responsible for cancellations, refunds, chargebacks, and correcting missing, corrupted, misdescribed, or unauthorised content. Any mandatory cancellation, refund, conformity, or consumer remedy under applicable law continues to apply regardless of a photographer's stated policy.

If a technical fault in 600mm prevents access to an otherwise valid delivery, contact us and the photographer promptly. We will use reasonable efforts to restore access or help the photographer issue a replacement link, without limiting any mandatory remedy.

7. Content Ownership and Licences

Photographers retain their copyright and other rights in content they upload.

By uploading content, the photographer grants 600mm a non-exclusive, worldwide, royalty-free licence, for as long as reasonably necessary to operate the Service, to host, store, back up, reproduce, transcode, resize, watermark, display as a preview, transmit, and technically deliver that content. This licence is limited to operating, securing, supporting, and improving the Service. It does not permit 600mm to use a person's image in unrelated advertising or social-media promotion without any separate permission required by law.

Buying or downloading a file does not transfer copyright. The buyer receives only the licence expressly agreed with the photographer. Unless the photographer clearly agrees otherwise in writing, the buyer must not resell, sublicense, commercially exploit, remove rights information from, or present the content as someone else's work.

Users grant 600mm a non-exclusive licence to use feedback they voluntarily provide for improving the Service, but not to publish their name, likeness, or private communications without permission.

8. People Shown in Content and Removal Requests

A person shown in a photo or video, or their authorised representative, may request review or removal by emailing hello@600mm.surf with:

  • the page URL or enough information to locate the content;
  • the reason for the request; and
  • reasonable information showing that they are the person shown or are authorised to act for that person.

Do not send unnecessary identity documents. We may ask for limited additional verification where needed to prevent fraudulent removal requests.

We may temporarily restrict content while reviewing a report, notify the photographer, request evidence of rights or consent, and remove or disable content where appropriate. We may preserve limited records where required for security, disputes, legal obligations, or establishment, exercise, or defence of legal claims.

For copyright complaints, identify the protected work, the allegedly infringing material, your contact information, the basis of your claim, and a good-faith statement that the information supplied is accurate and you are authorised to act.

9. Acceptable Use

You must not:

  • access accounts, originals, private links, or systems without authorisation;
  • bypass watermarks, access controls, link expiry, rate limits, or security measures;
  • scrape, bulk-download, copy, or republish content without permission;
  • upload malware or interfere with the availability or integrity of the Service;
  • use the Service for fraud, harassment, discrimination, exploitation, or unlawful surveillance;
  • collect personal data from the Service for unrelated marketing or profiling;
  • submit false orders, complaints, ownership claims, or payment confirmations; or
  • use the Service in violation of sanctions, export controls, court orders, or other applicable law.

10. Third-Party Services

The Service may link to or rely on third-party services, including WhatsApp and payment methods chosen independently by photographers and buyers. Those services have their own terms and privacy practices. 600mm does not control a conversation or transaction after a user chooses to continue through a third-party service.

11. Moderation, Suspension, and Termination

We may refuse, restrict, unpublish, or remove content, suspend an account, cancel an uncompleted technical order, or restrict access where reasonably necessary to:

  • enforce these Terms;
  • respond to a credible rights or safety complaint;
  • prevent fraud, abuse, or security harm;
  • comply with law or a lawful authority request; or
  • protect users, third parties, or the Service.

Where appropriate, we will consider the context, severity, repeat conduct, and available evidence. A photographer may ask us to close their account, subject to pending orders, disputes, security records, and legal retention duties.

12. Service Availability and Changes

The Service is provided on an evolving basis. Features, storage periods, limits, and availability may change. We may perform maintenance or discontinue a feature, but will use reasonable efforts to avoid unnecessary disruption and to communicate material changes where practical.

We do not guarantee that every session or file will remain available indefinitely, that every photographer will accept an order, or that third-party services will always function. This section does not exclude obligations or remedies that cannot lawfully be excluded.

13. Disclaimers and Liability

To the maximum extent permitted by applicable law, the Service is provided on an "as available" basis. We do not independently verify every photographer, ownership claim, release, listing, price, payment, or private agreement between a photographer and buyer.

To the maximum extent permitted by applicable law, 600mm is not liable for loss arising from a direct transaction or payment between a photographer and buyer, a photographer's content or conduct, a user's breach of their agreement, or the availability or conduct of a third-party service. 600mm is also not liable for indirect or consequential loss that was not reasonably foreseeable.

Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law, including liability arising from our own fraud, wilful misconduct, or other conduct for which liability cannot lawfully be excluded. No statement in these Terms transfers to a user a responsibility that applicable law requires 600mm to bear.

14. Indemnity for Business Users

If you use the Service as a photographer or for business purposes, then, to the extent permitted by applicable law, you will reimburse 600mm for reasonable losses, liabilities, and costs arising from your unlawful content, infringement of third-party rights, breach of these Terms, or direct transaction with a buyer. This does not apply to the extent the loss was caused by 600mm or cannot lawfully be shifted to you.

15. Changes to These Terms

We may update these Terms for legal, security, technical, or operational reasons. The page will show the effective date. If a change materially affects registered users, we will provide reasonable notice and request renewed acceptance where required by law. Changes do not retroactively alter an already completed direct sale unless the parties and applicable law allow it.

16. General

If a provision is invalid or unenforceable, the remaining provisions continue to apply, and the invalid provision will be adjusted only to the minimum extent permitted by law. A delay in enforcing a provision is not a waiver. We may assign these Terms only in connection with a genuine transfer or restructuring of the Service and subject to applicable law. Users may not assign their account or these Terms without our consent.

These Terms, the Privacy Policy, any applicable local addendum, and any specific terms displayed for a feature form the agreement between you and 600mm about the Service. The direct sale agreement between photographer and buyer remains separate.
